  • Late Payments: A 1% monthly service charge may be applied to payments received after 30 days.
  • Credit Card Transactions: Times Square Lighting reserves the right to set credit card limits, and any processing fees incurred may be passed on to the customer.

Shipping, Delivery, and Title of Goods

Times Square Lighting ships all orders FOB Stony Point, New York, using trusted carriers to ensure timely and safe delivery. Key points include:

  • Customers assume responsibility for freight once goods leave our facility.
  • Any claims for shortages, damages, or shipping errors must be submitted within 7 days of receipt. Failure to report within this timeframe may result in waiver of claims.
  • Times Square Lighting reserves the right to make partial shipments unless otherwise noted.

We encourage customers to inspect shipments promptly upon arrival to confirm that all items are received in proper condition and quantity.

Liability Limitations

  • Times Square Lighting is not responsible for indirect, incidental, or consequential damages arising from the use of our products.
  • We are not liable for costs associated with removal, shipping, or reinstallation of defective products, even when repairing or replacing items under our warranty.
  • Any use of third-party products in combination with our fixtures or lighting solutions is done at the customer’s own risk. Times Square Lighting assumes no responsibility for damages resulting from such usage.

Intellectual Property

All content on the Times Square Lighting website, including the TS Stage and Times Square Lighting logos, product images, technical drawings, and brand assets, is the intellectual property of Times Square Lighting Co., Inc. or its licensors.

  • Use Restrictions: You may not copy, reproduce, distribute, or display any content without prior written permission.
  • Brand Guidelines: Any use of the TS Stage or Times Square Lighting logos for promotional or commercial purposes requires explicit authorization from our marketing team.

Pricing and Quotation Errors

Times Square Lighting strives to ensure that all product prices, promotions, and catalog listings are accurate. However, errors can occur. Our policies regarding pricing errors are as follows:

  • If a product is listed at an incorrect price due to typographical or technical errors, Times Square Lighting reserves the right to cancel the order and notify the customer promptly.
  • Any deposits or payments received for such orders will be fully refunded.
  • Customers are encouraged to review their order confirmations carefully and report any discrepancies immediately.

Returns, Cancellations, and Special Orders

Times Square Lighting offers clear policies to manage product returns and order cancellations:

  • Returns: Merchandise may only be returned with written authorization within 14 days of shipment and must arrive within 30 days in original packaging. A 40% restocking and handling fee may apply. Custom or modified orders are non-returnable.
  • Cancellations: Catalog orders canceled within two weeks of the scheduled shipment may incur a 50% restocking fee. Special or custom orders may not be canceled.
  • Orders on Hold: Production does not begin until we receive written authorization to release held orders. Invoicing reflects current pricing at the time of release.

These policies are designed to balance flexibility for customers with operational efficiency for Times Square Lighting and TS Stage.

Warranty and Product Liability

All fixtures manufactured by Times Square Lighting are subject to our five-year warranty, which covers defects in materials and workmanship. Key details include:

  • TSL will repair or replace defective products at its discretion, FOB factory.
  • Customers are responsible for removal, shipping, and reinstallation.
  • Warranty does not cover products damaged by misuse, accident, or third-party modifications.
  • Third-party components, such as ballasts, LEDs, or dimmers, are warranted by their respective manufacturers.

This warranty provides assurance of quality while clarifying the limits of our obligations.

Amendments and Updates

Times Square Lighting reserves the right to update these Terms & Conditions at any time. Updated terms will be posted on our website, and continued use of our site or services constitutes acceptance of the changes. Customers are encouraged to review these terms periodically to stay informed.
